Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and GlowRep. They govern your access to and use of the GlowRep website, dashboard, and related features. Please read them carefully. By creating an account or using GlowRep, you agree to these Terms.

1. The agreement

"GlowRep", "we", "us", and "our" refer to the GlowRep service, operated by Terence Falvey. "You" refers to the person or business that uses GlowRep. If you use GlowRep on behalf of a company, you represent that you have authority to bind that company to these Terms, and "you" includes that company. Our Privacy Policy is incorporated into these Terms by reference.

2. The Service

GlowRep is an online reputation and review-management tool for local and home-services businesses. It analyzes your publicly available reviews, generates AI-assisted analysis and draft replies, and—on eligible plans—helps you run review-request and referral campaigns by email and, where offered, SMS. We may add, change, or remove features over time.

3. Accounts & eligibility

You must be at least 18 years old and able to form a binding contract to use GlowRep. We use passwordless "magic link" sign-in, so you are responsible for keeping access to your email account secure. You are responsible for all activity under your account. Notify us promptly at hello@glowrep.io if you suspect unauthorized use. The information you provide must be accurate and kept up to date.

4. Free trial

GlowRep offers a free 30-day trial that does not require a credit card and does not automatically convert into a paid subscription. The trial is handled within the app and does not charge you. To continue with paid features after the trial, you must actively upgrade to a paid plan. We may modify or discontinue trial offers at any time.

5. Plans & billing

Paid plans are billed in advance on a recurring basis (for example, monthly, every six months, or annually, depending on the term you choose). Current plans and prices are shown in the dashboard and on our website at the time you upgrade.

Payments are processed by Stripe. By upgrading, you authorize us, through Stripe, to charge your chosen payment method for the applicable subscription fees, including automatically at the start of each renewal term, until you cancel. You authorize the storage of your payment method by Stripe for this purpose. GlowRep does not store your full card details.

Unless stated otherwise, fees are exclusive of taxes, and you are responsible for any applicable taxes. We may change our prices; if we change the price of a plan you are on, we will give you reasonable advance notice, and the change will take effect at your next renewal.

6. Cancellation & refunds

You can cancel a paid subscription at any time. When you cancel, your plan remains active through the end of the current paid term, and it will not renew after that. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods or unused features. If you believe you were billed in error, contact us at hello@glowrep.io and we'll work with you in good faith.

7. Acceptable use

You agree not to:

• use GlowRep for any unlawful, deceptive, or fraudulent purpose;
• post, generate, or solicit fake, incentivized-in-violation-of-platform-rules, or otherwise deceptive reviews, or otherwise violate the terms of any review platform (such as Google);
• send spam or messages to people who have not consented or whom you have no lawful basis to contact;
• upload data you do not have the right to use, or that infringes others' rights or privacy;
• attempt to disrupt, reverse-engineer, scrape beyond permitted use, overload, or gain unauthorized access to the Service;
• resell or provide access to the Service except as expressly permitted by your plan (for example, an Agency plan); or
• use the Service to build a competing product.

8. Campaigns & messaging

If you use GlowRep to send review requests, referral invitations, or other messages, you are solely responsible for the recipients you choose and the content you send. You represent that you have all necessary rights and consents to contact those recipients and that your use complies with all applicable laws, including anti-spam and telemarketing laws such as CAN-SPAM and the TCPA. You must honor opt-out requests. GlowRep provides the tooling; you remain the sender and the party responsible for your campaigns.

9. Your content & data

You retain all rights to the data and content you provide to GlowRep, including your business information and uploaded contact lists ("Your Content"). You grant us a limited, non-exclusive license to host, process, and use Your Content solely to provide and improve the Service for you and as described in our Privacy Policy. You are responsible for the accuracy and legality of Your Content.

10. AI-generated output

GlowRep uses artificial intelligence to produce analysis, draft replies, and campaign copy. These outputs are suggestions and may contain errors or inaccuracies. You are responsible for reviewing and approving any AI-generated content before you post, send, or otherwise rely on it. GlowRep is not responsible for content you choose to publish.

11. Our intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by GlowRep and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms and your plan. All rights not expressly granted are reserved. "GlowRep" and our logo are our marks and may not be used without permission.

12. Third-party services

GlowRep relies on and integrates with third-party services, such as Cloudflare, Stripe, Brevo, AI providers, and review platforms like Google. Your use of those services may be subject to their own terms, and we are not responsible for their acts, omissions, availability, or content.

13. Suspension & termination

You may stop using GlowRep and close your account at any time. We may suspend or terminate your access if you breach these Terms, if your use poses a risk to the Service or others, or if required by law. We may also discontinue the Service with reasonable notice. On termination, your right to use the Service ends; sections that by their nature should survive (such as billing owed, intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that it will produce any particular business result, ranking, number of reviews, or revenue. Reputation outcomes depend on many factors outside our control.

15. Limitation of liability

To the maximum extent permitted by law, GlowRep and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the amount you paid to GlowRep in the three (3) months immediately before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless GlowRep and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to Your Content, your campaigns and the recipients you contact, your violation of these Terms or applicable law, or your infringement of any third party's rights.

17. Governing law

These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Connecticut will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction there. Before filing any claim, you agree to first contact us at hello@glowrep.io so we can try to resolve the matter informally.

18. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you by email or in the dashboard. Your continued use of the Service after an update means you accept the revised Terms. If you do not agree, you should stop using the Service.
